Welcome to westbyforcongress.com (the “Site”), the official website of Westby for Congress (the “Campaign,” “we,” “us,” or “our”).


By accessing or using this Site, you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree to these Terms, please do not use the Site.

 

1. Use of the Site

 

1.1 You may use this Site only for lawful purposes and in a manner consistent with these Terms and all applicable federal, state, and local laws and regulations.

1.2 This Site is intended for users located in the United States. If you access the Site from outside the U.S., you are responsible for compliance with local laws.

1.3 We may modify, suspend, or terminate the Site, or your access to it, at any time without notice, for any reason or no reason.

2. No Legal, Tax, or Financial Advice

Content on this Site is provided for informational and political/advocacy purposes only. Nothing on this Site constitutes legal, tax, financial, or other professional advice. You should consult your own advisors regarding any legal, tax, or financial questions.

 

3. Contributions and Donations

3.1 Eligibility to Contribute
By making a contribution through this Site, you represent and warrant that:

  • You are a U.S. citizen or lawfully admitted permanent resident (green card holder);

  • You are making this contribution with your own personal funds, not those of another person or entity;

  • You are not making this contribution in the name of another person;

  • You are not a federal contractor prohibited from contributing; and

  • You are at least 18 years old.

3.2 Contribution Limits and Reporting
Campaign contributions are subject to limits and source restrictions under federal campaign‑finance law and other applicable regulations. Contribution information may be publicly disclosed in reports filed with the Federal Election Commission (FEC) and, where applicable, other regulatory bodies.

3.3 Non‑Tax‑Deductible
Contributions to Westby for Congress are not tax‑deductible as charitable contributions for federal income tax purposes.

3.4 Refunds
Contributions are generally final. However, the Campaign may, in its sole discretion, issue a refund if required by law or if a contribution is determined to be ineligible or impermissible.

3.5 Payment Processing
Online donations may be processed by a third‑party payment processor. By submitting payment information, you authorize the Campaign and its payment processor to charge the amount you specify. We are not responsible for errors by third‑party processors, but we will work in good faith to resolve issues that come to our attention.

4. Email, SMS, and Other Communications

4.1 By providing your contact information (such as email address or mobile number) through forms on the Site, you consent to receive communications from the Campaign, including emails, text messages, and phone calls, as permitted by law.

4.2 You may opt out of email communications by using the unsubscribe link in our emails, and may opt out of text messages by replying STOP to campaign texts. Opting out may not prevent important transactional communications related to your contributions or specific requests you make.

5. Intellectual Property

5.1 Unless otherwise noted, all content on the Site—including text, graphics, logos, photographs, videos, and other materials—is owned by or licensed to the Campaign and is protected by copyright, trademark, and other intellectual‑property laws.

5.2 You may view, download, and print content from the Site for your personal, non‑commercial use in connection with supporting the Campaign. Any other use, including reproduction, distribution, modification, or creation of derivative works, is prohibited without our prior written consent.

5.3 The names, logos, and slogans associated with Westby for Congress are campaign trademarks or service marks and may not be used without our express permission.

6. User Conduct and Submitted Content

6.1 You agree not to:

  • Use the Site in any way that could disable, overburden, or impair it;

  • Attempt to gain unauthorized access to any part of the Site, other accounts, or systems;

  • Upload or transmit viruses, malware, or other harmful code;

  • Use the Site to harass, threaten, defame, or otherwise harm others;

  • Use the Site for any fraudulent or unlawful purpose.

6.2 If the Site allows you to submit comments, stories, images, or other content (“User Content”), you grant the Campaign a non‑exclusive, royalty‑free, worldwide license to use, reproduce, modify, publish, display, and distribute such User Content in any media for campaign purposes.

6.3 You represent and warrant that you own or have the necessary rights to any User Content you submit, and that your User Content will not violate any law or the rights of any third party.

We reserve the right (but are not obligated) to remove or refuse any User Content in our sole discretion.

7. Privacy

Our collection and use of personal information through the Site is described in our Privacy Policy, which is incorporated by reference into these Terms. By using the Site, you consent to our collection and use of your information as described in the Privacy Policy.

8. Third‑Party Websites and Services

The Site may contain links to third‑party websites, services, or social media platforms that are not owned or controlled by the Campaign. We are not responsible for the content, policies, or practices of any third‑party sites or services. Accessing third‑party sites is at your own risk, and you should review their terms and privacy policies.

9. Disclaimers

9.1 No Warranty
The Site and all content on it are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

9.2 We do not warrant that the Site will be uninterrupted, error‑free, secure, or free of viruses or other harmful components, or that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, the Campaign, its candidate, officers, employees, volunteers, consultants, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of or inability to use the Site, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to the Site or these Terms will not exceed the amount you have contributed to the Campaign through the Site in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow limitations of certain damages or liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Campaign, its candidate, officers, employees, volunteers, consultants, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site;

  • Your violation of these Terms; or

  • Your violation of any rights of another person or entity.

12. Governing Law and Dispute Resolution

These Terms and your use of the Site are governed by the laws of the State of Minnesota and applicable federal law, without regard to conflict‑of‑law principles.

Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to the personal jurisdiction and venue of such courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top of this page. Your continued use of the Site after we post changes means you accept the updated Terms.
