Refund Policy

Effective Date: November 14, 2025

This Refund & Cancellation Policy (“Policy”) explains how Westby for Congress (the “Campaign,” “we,” “us,” or “our”) handles contributions (donations) and merchandise orders made through westbyforcongress.com (the “Site”).

This Policy is incorporated into and forms part of our Terms & Conditions. By making a contribution or placing an order through the Site, you agree to this Policy.

1. Scope of This Policy

This Policy covers:

  • Political contributions made to the Campaign through the Site; and

  • Merchandise purchases made through any online store or order form hosted on or linked from the Site.

  • It does not govern any separate programs run by government agencies—such as Minnesota’s Political Contribution Refund (PCR) Program, which is administered by the State of Minnesota, not by this Campaign.
     

2. Contributions (Donations)
2.1 General rule: contributions are final

Contributions to Westby for Congress are used to support our federal campaign and are subject to federal campaign‑finance rules. As a general policy, and to the fullest extent allowed by law, all contributions are considered final and non‑refundable. 
 

We encourage donors to double‑check the amount, billing information, and whether the contribution is one‑time or recurring before submitting.

2.2 Mistaken, duplicate, or unauthorized contributions

We understand that honest mistakes can happen (for example, entering the wrong amount, submitting duplicate contributions, or discovering a charge you did not authorize).

If you believe a contribution was:

  • Made in error,

  • Duplicated, or

  • Made without your authorization,

  • please contact us as soon as possible, and no later than 30 days from the date of the contribution:

Subject line: “Contribution Refund Request – [Your Name]”

Please include:

  • Your full name

  • The date and amount of the contribution

  • The last four digits of the card used (if applicable)

  • A brief explanation of the issue

Important:

  • We do not guarantee that any contribution will be refunded.

  • Any refund must comply with federal law and Federal Election Commission (FEC) regulations, including record‑keeping and reporting of refunded contributions.
     

If funds have already been used or are otherwise unavailable, we may not be able to issue a refund even if the request is timely.

We may, in our sole discretion, issue a refund, void a transaction, or work with our payment processor to address the charge, subject to law and the availability of funds.

2.3 Recurring contributions

If you enroll in recurring contributions (for example, monthly donations):

You may cancel future recurring charges at any time by following the instructions in the confirmation email, on the contribution page, or by contacting us at donations(at)westbyforcongress.com.

Requests to cancel only stop future charges. They do not automatically result in refunds of past contributions.

We may consider refund requests for recent recurring charges under Section 2.2, but such refunds are not guaranteed.

2.4 Excessive or impermissible contributions (legal requirement)

In some cases, we may be legally required to refund or reattribute a contribution, such as when:

  • The contribution exceeds applicable legal limits; or

  • The contribution is from a prohibited source (for example, certain corporations, foreign nationals, or federal contractors, under federal law).
     

When we discover that a contribution is excessive or otherwise impermissible and cannot be corrected, we will refund or return the contribution as required by law, and report any such refund in our FEC filings.

2.5 Minnesota Political Contribution Refund (PCR) Program

Minnesota has a separate Political Contribution Refund (PCR) program that allows eligible Minnesota residents to seek a refund of certain contributions to qualifying state‑level candidates and parties directly from the State of Minnesota.

This is not a refund by the Campaign.

Eligibility and refund amounts are determined by Minnesota law and the Minnesota Department of Revenue.

Donors interested in the PCR program should consult the official Minnesota Department of Revenue materials or their tax advisor.

Our Campaign does not process PCR requests and cannot guarantee any refund under that state program.

3. Merchandise Orders

This section applies to physical items (such as shirts, hats, stickers, etc.) offered by the Campaign through the Site or a linked store.

3.1 General merchandise refund & return policy

Except as stated in this Policy:

We will generally accept returns of eligible merchandise for a refund or exchange if you contact us within 30 days of the delivery date and return the item to us in accordance with this Policy.

We do not provide refunds for merchandise that has been ordered, shipped, and not returned.

Subject line: “Merchandise Return – Order #[Order Number]”

You are responsible for the cost of return shipping unless the item was defective, damaged upon arrival, or we shipped the wrong item.

3.2 Condition of returned items

To qualify for a refund or exchange:

  • Items must be unworn, unwashed, and unused;

  • Items must be returned in their original condition with tags/labels (if any) and packaging; and

  • Your return must include proof of purchase (such as an order confirmation or packing slip).

  • We reserve the right to deny a refund or exchange for any item that:

  • Shows signs of wear or use,

  • Has been washed, altered, or damaged after delivery, or

  • Is returned without proof of purchase.

 

3.3 Non‑returnable / non‑refundable items

The following items are final sale and not eligible for return, refund, or exchange, except where required by law:

  • Customized or personalized items

  • Items marked as “final sale” at the time of purchase

  • Downloadable or digital products (if any)

  • Items that have been worn, used, or damaged after delivery

 

We also do not provide refunds for:

  • Merchandise that has been shipped and not returned to us; or

  • Shipping and handling charges, except where we have shipped the wrong item or the product was damaged in transit and you followed the procedures in Section 3.4.

 

3.4 Damaged, defective, or incorrect items

If your order arrives damaged, defective, or incorrect:

Contact us at store(at)westbyforcongress.com within 14 days of delivery.

Include your order number, a description of the issue, and photos of the product and packaging (if applicable).

Where appropriate, we may:

  • Replace the item,

  • Offer a comparable item, or

  • Provide a refund, at our discretion and subject to product availability and applicable law.

3.5 Lost or undelivered orders

If tracking shows that your order was not delivered, or you believe it was lost in transit:

Please contact us promptly with your order number and any tracking information.

We will work with the carrier to investigate.

At our discretion, we may reship your order or provide another appropriate remedy. We typically do not provide refunds for orders that tracking shows as delivered, but we will review issues case by case.

  • Your full name

  • Your email address used for the order or contribution

  • Date and amount (for contributions) or order number (for merchandise)

  • A brief explanation of the issue

  • Any supporting documentation, such as order confirmations, receipts, or photos (for damaged items)

We will review your request and respond within a reasonable time. We may request additional information to verify your identity and the transaction.

 

5. Legal Disclaimer

5.1 No guarantee of refunds for contributions

Nothing in this Policy should be interpreted as a promise or guarantee that any political contribution will be refunded at your request. Except where required by law (for example, in the case of certain impermissible or excessive contributions), contributions are generally final and non‑refundable, and any refund of a contribution is at the Campaign’s sole discretion, subject to federal campaign‑finance law and FEC regulations.
 

5.2 Compliance with law

If this Policy conflicts with any applicable law or regulation, including federal campaign‑finance law, that law or regulation will control to the extent of the conflict, and the Policy will be interpreted to be consistent with such law.

5.3 No legal or tax advice

Nothing in this Policy is intended to constitute legal, tax, or financial advice. Donors and purchasers should consult their own legal or tax advisors about the consequences of contributions, refunds, or merchandise purchases.

5.4 Rights that cannot be limited

Some jurisdictions provide consumers with specific rights regarding returns or refunds for merchandise. To the extent such laws apply to you and cannot be modified by agreement, nothing in this Policy is intended to limit those rights.

5.5 Changes to this Policy

We may update or modify this Policy at any time. When we do, we will revise the “Effective Date” above. Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Policy.
